GENERAL CONDITIONS OF THE CONTRACT

Welcome to www.albaresidence.it, where you can reserve and purchase accommodation services at our establishments in Alba: “Masera 26” and “Vico 01”.

Please read carefully the following terms and conditions that govern the service. Alba residence Srl reserves the right to alter the terms and conditions without notice when necessary due to changes in the market, regulatory changes or variations in the provision of the service. In any event, the use of the website and its freely accessible functions constitutes acceptance of these general conditions. These General Conditions govern the purchase of accommodation reservations online on the www.albaresidence.it website and the related contract concluded between Alba Residence Srl and users of the website. Each purchase transaction will be governed by the provisions of Italian Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”), as amended, with respect to distance contracts, where applicable. This is without prejudice to the option of entering into -specific agreements, where possible, and subject to these general conditions. 

1. ACCEPTANCE OF THE GENERAL CONDITIONS

The Customer, by sending the confirmation of his/her purchase order electronically, unconditionally accepts and undertakes to comply with these general conditions, declaring that he/she has read and accepted all the information provided to him/her in accordance with the aforementioned rules, also acknowledging that Alba residence Srl shall not be bound by different conditions unless previously agreed in writing. Where one or more of the clauses of these General Conditions is partially or fully void or invalid, this shall not in any way affect the validity of the remaining provisions of the contract, which shall be deemed to be entirely valid and effective. In lieu of the invalid or effective condition, another provision shall be applied which is consistent with the economic objectives of the agreement.

2. CUSTOMER’S OBLIGATIONS

  • These General Conditions must be read carefully online by the Customers of the website albaresidence.it before they confirm their reservation. The confirmation of the order therefore implies full knowledge of these General Conditions and their full acceptance.
  • Once the online purchase procedure has been completed, the Customer undertakes to print and keep these general conditions, already viewed and accepted during the booking process, in order to fully comply with the provisions of Articles 52 and 53 of Italian Legislative Decree No. 206/2005/94.
  • To purchase Albaresidence accommodation services, you must be at least 18 years old or be of legal age according to the laws of the country of which you are a citizen.
  • A minor may use the accommodation services alone as long as the parent or guardian provides an authorization for him/her to stay in the establishment and signs a liability disclaimer.

3. PURCHASE METHOD

  • The purchase of accommodation services on albaresidence.it is made by the customer at the total price indicated on the website, which is accepted at the time of sending the reservation confirmation;
  • Prior to confirming the reservation, the Customer will be provided with a summary of the total cost of the travel services requested.
  • After confirming the reservation and providing a credit card number as a security deposit, the Customer will receive an email at the address indicated containing a summary of his/her order, the reservation number and the specific details of the service and the cancellation terms.

N.B. 
The reservation summary must be checked. It is essential that all the information (dates, times, names of guests, addresses) is correct. If even minor inaccuracies (e.g. names spelt incorrectly) are discovered due to an error in the information entered by the customer, the customer shall be fully liable for the error in question and Albaresidence must be contacted immediately. In the event of a cancellation, annulment, or non-receipt of the price of the service booked, or if there are reasonable grounds to believe that the reservation is fraudulent, Albaresidence reserves the right to cancel the reservation. If it is impossible to contact the customer, Albaresidence may decide not to confirm or cancel the reservation without incurring any liability whatsoever.

4. CONCLUSION OF THE CONTRACT

The contract is concluded upon acceptance of the reservation by Albaresidence. At the same time, the guest must provide a credit card number to secure the reservation.

5. EXCLUSION OF THE RIGHT OF WITHDRAWAL – PENALTY IN THE EVENT OF CANCELLATION OR EARLY DEPARTURE

Pursuant to Article 59 of Italian Legislative Decree of 6 September 2005 No. 206 “Consumer Code”, as amended, the applicability of withdrawal from the contract is excluded. Nevertheless, Albaresidence allows the Customer to cancel the reservation by midday (12 p.m.) on the day before arrival. After this time Albaresidence is entitled to apply, as compensation, the penalty of 100% of the total price of the reservation.

In the event of early check-out, the management is entitled to request payment of the entire period booked, invoicing every night until the end of the reservation.

6. START AND END OF STAY

Rooms in all facilities are normally available from 3 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure. Any early check-in or late check-out after the indicated time is subject to a supplementary charge, to be confirmed by the establishment itself. 

7. PREFERENCES AT THE TIME OF BOOKING

Any room preferences indicated by customers (e.g.: ground floor, double beds, etc) are not binding on Albaresidence, which is entitled to choose whether or not to accept them depending on availability. 

8. RIGHTS OF THE GUEST

A guest whose reservation has been duly confirmed is entitled to the normal use of the premises of the establishment, made available to guests without specific conditions, and the normal service. The guest may exercise his/her rights in compliance with all the guidelines and regulations applicable to the establishment.

9. OBLIGATIONS OF THE GUEST

Upon arrival, the guest is required to pay the cost of his/her stay in addition to the tourist tax. The following payment methods are accepted: advance bank transfer, cash, debit card, credit card and electronic payments.

10. OBLIGATIONS OF THE HOTEL

Albaresidence is required to provide the agreed facilities and services in a manner that is consistent with its standards. The establishment may provide guests with adequate replacement accommodation (of the same quality) in the event of, for example, unusable room(s), extended stay of guests occupying the room in question, overbooking or other major hotel requirements requiring such a decision. Any additional costs related to the replacement accommodation shall be borne by the hotel.

11. LIABILITY FOR DAMAGE TO PROPERTY

Albaresidence shall be liable for any damage suffered by the guest if this occurred on the premises of the establishment and it or its employees are responsible for such damage. 

The customer is responsible for damage to the structure of the establishment or to the furnishings. Any damage will be charged to the account of the customer who caused them. Under no circumstances may the furnishings in the rooms be moved without the permission of the management.

Any missing items or linen shall be charged to the customer’s account. It is strictly forbidden to take out of the establishment the linen supplied to the rooms, since this is exclusively for use in the rooms.

The management shall not be liable for any property kept in the rooms’ safes or for any objects left in the rooms.

12. MAINTENANCE

Albaresidence reserves the right to make changes to the organization and the establishment while it is open to the public. As part of the necessary maintenance activities, the customer shall agree, without any right to a refund, that works may be carried out to the accommodation or the establishment while he/she is staying there. 

13. ANIMALS

Animals may not be brought into the establishment.

14. EXTENSION OF STAY

The guest cannot insist on an extension to his/her stay. Any extension must always be accepted by the establishment. If the guest is unable to leave the apartment on the scheduled departure date due to extraordinary and unforeseeable circumstances (e.g. natural disasters, floods, strikes, etc.) that preclude all possible means of travelling, the accommodation contract will be automatically extended for as long as it is impossible to travel. Albaresidence is entitled in such cases to charge at least the standard rate for the accommodation provided.

15. TERMINATION OF CONTRACT – FORCE MAJEURE

Albaresidence may terminate the contract with immediate effect if the guest:

  • uses the premises in a manner that seriously damages the property or makes peaceful coexistence with other guests impossible, by behaving in an overbearing, disrespectful, scandalous or in any case inconsiderate manner or engages in acts or omissions with respect to the accommodation service provider, staff, other guests and/or persons located in the Hotel that are punishable by law as a criminal offence, with respect to property rights, morality and the physical wellbeing of others.
  • has a contagious disease or a disease whose duration exceeds the agreed period of stay, or if special treatment is necessary

If the performance of the contract is prevented due to force majeure events (e.g. natural disasters, strikes, lockouts, official orders, etc.), Albaresidence may terminate the contract at any time without prior notice, if the contract is not deemed to have already been terminated by operation of law, or if the establishment has not already been released from its obligation in this regard. Any right to claim compensation for any damage etc from Albaresidence Srl is excluded.

16. COMPLAINTS

If a guest considers it necessary to make a complaint in relation to his/her stay, the reasons must be notified in situ, directly to the management of the establishment. Any guest who is not satisfied with the way in which his/her complaint is handled has 8 days after check-out to file a written complaint, providing a detailed explanation of the reasons for the same. 

17. GOVERNING LAW AND JURISDICTION

These terms and conditions, as well as the relationship between users and Albaresidence, are governed by Italian law. The court for the place of residence or domicile of the customer, if located in Italian territory, shall have exclusive jurisdiction over any dispute that may arise between customers and Albaresidence Srl.
